Contracting in Switzerland can be daunting if you are not familiar with the Swiss Labour Laws, however Swiss Labour Law does not impose a specific form of employment contract.

Employment contracts can be either verbal or written.  It is best to have a written contract based upon the Swiss Code of Obligations and Federal Law.  In this contract it can be set out whether or not the employment contract is governed by the Swiss Code of Obligations and Federal Law.

For contractors working in Switzerland to avoid problems of self-employment or the expense and hassle of setting up a Switzerland company it is a common solution to go through an umbrella or payroll company who will be able to take care of the paperwork and necessary contributions for you.

Upon request employers are obliged to supply an employment certificate, this can be at any time during or after the employment term.

If you have any concerns regarding your employment and the labour law you can consult with Lawyers who are members of the Geneva Bar Association’s Consultancy Service who will be able to offer advice at a lower fee.
